Scope 2 Estimate Terms of Service

These Terms govern the current Scope 2 Estimate website, signup forms, and available user portals (the “Services”) operated by Scope 2 Estimate LLC (“S2E,” “we,” or “us”). The public estimating app is coming soon. We will update these Terms before making it available with new estimating, AI, mobile, subscription, or payment functions. By using the current website or creating an account, you agree to these Terms and our Privacy Policy.

1 Eligibility and accounts

You must be at least 18 and able to enter a binding agreement. If you act for a business, you represent that you have authority to do so. Provide accurate information, keep it current, protect your login credentials, and tell us promptly about unauthorized account access. You are responsible for activity by people you authorize to use your account.

2 Website forms and portal information

The Home Owner, Trade Partner, and Partner Program forms let you express interest and provide information for S2E to review. Submitting a form does not guarantee acceptance into a program, a lead, a bid, a project, an investment opportunity, or a contract. The owner portal is for authorized S2E personnel to review submissions and record follow-up; a user portal may let you view updates and edit your profile.

Contacting another person through information obtained from the website requires you to comply with applicable laws and obtain any needed permissions. Do not submit information about a third person unless you are authorized to do so.

3 Planned app and estimates

The estimating app is under development and is not currently offered as a public production service. Descriptions of upcoming AI, pricing, matching, or estimating features do not promise a launch date, capability, price, or result. We will provide applicable terms before users access those features.

If S2E makes a preview or sample estimate available, treat it as preliminary planning information. Verify measurements, scope, prices, site conditions, permits, code requirements, and professional advice before relying on it or making a project decision. A sample or software output is not a construction bid, guaranteed price, physical inspection, professional opinion, or S2E offer to perform work.

4 No current payment feature

The website does not currently offer checkout, paid subscriptions, or payments between users. Do not enter payment-card information in signup forms or project messages. Any future charges, renewal terms, refunds, and payment provider terms will be disclosed before a paid feature is offered.

5 Your content

You retain ownership of information and materials you submit (“User Content”). You give S2E a nonexclusive license to host, store, display, transmit, and process that content as needed to operate the current website and portal, respond to requests, secure the service, and comply with law. You represent that you have the rights and permissions needed to provide it. The Privacy Policy explains how personal information is handled.

6 Acceptable use

Do not use the service to violate law or another person’s rights; submit false or misleading information; impersonate someone; upload malware; interfere with security; gain unauthorized access; scrape information at scale without permission; misuse another person’s confidential information; or send unlawful communications. We may investigate misuse and suspend access when reasonably necessary.

7 Third parties and availability

External links and services, including email services used for correspondence, have their own terms and policies. S2E is not responsible for their independent practices. We may change, pause, or discontinue website and portal features. Service interruptions and errors may occur, so keep copies of information needed for your own records.

8 Intellectual property and notices

S2E owns its website, software, design, branding, and other materials, excluding your User Content. You may use them only as permitted by these Terms. Send copyright notices with the information required by applicable law to legal@scope2estimate.com or by mail to the address below.

9 Suspension and termination

You may ask to close your account by emailing support@scope2estimate.com. We may suspend or end access for misuse, security risks, legal requirements, or a material breach of these Terms. Handling of account information after closure follows the Privacy Policy and applicable law.

10 Disclaimers and liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CURRENT WEBSITE, PORTALS, AND ANY PREVIEW CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED OPERATION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, S2E AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATED TO THE CURRENT FREE WEBSITE AND PORTAL WILL NOT EXCEED $100. THESE LIMITS DO NOT EXCLUDE LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

11 Arizona law arbitration and class action waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

These Terms are governed by Arizona law, without regard to conflict-of-laws principles. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Before starting arbitration, a party must send a written notice describing the claim, supporting facts, and requested relief to the other party. Notices to Scope 2 Estimate must be sent by certified mail to 3120 W Carefree Hwy Ste 1-633, Phoenix, AZ 85086, Attn: Legal, with a copy to legal@scope2estimate.com. The parties will attempt in good faith to resolve the dispute for 60 days after receipt.

Except for the exceptions below, any dispute arising out of or relating to these Terms or the Services that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules or Commercial Arbitration Rules, as appropriate. Arbitration may occur by video, telephone, written submissions, or in Maricopa County, Arizona, as permitted by the applicable rules. The arbitrator may award the same individual remedies a court could award.

YOU AND SCOPE 2 ESTIMATE AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION. YOU AND SCOPE 2 ESTIMATE WAIVE A JURY TRIAL TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Either party may bring an eligible individual claim in small-claims court. Either party may seek temporary or injunctive relief in court to protect intellectual property, confidential information, or system security.

You may opt out of arbitration within 30 days after first accepting these Terms by emailing legal@scope2estimate.com with your full name, account email, and a clear statement that you opt out. If you opt out, other Terms remain effective. For claims not subject to arbitration, the parties consent to exclusive jurisdiction in the state and federal courts located in Maricopa County, Arizona.

To the extent permitted by law, any claim must be filed within one year after it arose or it is permanently barred. Arbitration proceedings and awards will be confidential except as needed to enforce an award, comply with law, or obtain professional advice. This Section survives termination.

12 Changes and contact

We may update these Terms as the website changes and will publish a new effective date. Before the app launches, we will review and revise these Terms for its actual features, data flows, and payment arrangements. Material changes will be communicated as required by law.
